ILRC Comment Opposing Proposed Form I-130 Changes

The Immigrant Legal Resource Center (ILRC) submitted a comment to USCIS opposing proposed changes to Form I-130, which would more than double the form’s length and require additional information from petitioners and beneficiaries, including expanded criminal history, employment, education, and family-history questions. ILRC explains that many of these new requirements go beyond the legal purpose of the family petition, create unnecessary burdens for immigrant families and legal service providers, and raise concerns under the Paperwork Reduction Act and Administrative Procedure Act. ILRC urges USCIS to withdraw the proposed changes and preserve a family-based petition process focused on the legally relevant questions of petitioner status and the qualifying family relationship.
